End User License Agreement

This End User License Agreement (“Agreement”) constitutes a legally binding agreement between you (“User” or “You”) and appforest (“Company,” “We,” “Our,” or “Us”) regarding your use of our software, applications, and related services (collectively, the “Software”).

By downloading, installing, accessing, or using the Software, You agree to comply with the terms of this Agreement. If You do not agree with these terms, You must not download, install, or use the Software.

1. License Grant

1.1 Scope of License

We grant You a limited, non-exclusive, non-transferable, non-sublicensable, and revocable license to:

• Install and use the Software on supported devices owned or controlled by You.
• Use the Software solely for personal or internal business purposes, as permitted by this Agreement.

1.2 Restrictions

You agree not to:

• Reverse-engineer, decompile, disassemble, or derive the source code of the Software.
• Copy, modify, adapt, translate, or create derivative works based on the Software.
• Distribute, sell, lease, rent, or sublicense the Software to any third party.
• Remove, alter, or obscure any proprietary notices, labels, or trademarks on the Software.
• Use the Software for any unlawful or unauthorized purposes, including violating intellectual property rights or applicable laws.

2. Ownership and Intellectual Property

The Software, including all copyrights, trademarks, patents, and other intellectual property rights, is and remains the sole property of appforest or its licensors. This Agreement does not grant You ownership of the Software but only a license to use it in accordance with the terms herein.

3. Software Updates and Modifications

3.1 Automatic Updates

We may provide updates, patches, or modifications to improve the Software. By using the Software, You consent to automatic updates, which are governed by this Agreement unless accompanied by separate terms.

3.2 Feature Changes

appforest reserves the right to modify, suspend, or discontinue any features of the Software at any time without prior notice.

4. Third-Party Integrations

The Software may include integrations with third-party services or tools. appforest is not responsible for the functionality, security, or accuracy of such third-party services. Use of third-party services is subject to their respective terms and conditions.

5. Subscription Terms

5.1 Billing

Certain features of the Software may be offered on a subscription basis. By subscribing, you agree to pay all fees associated with the subscription plan you selected.

5.2 Renewal and Cancellation

• Subscriptions automatically renew unless canceled before the renewal date.
• You may cancel your subscription at any time via your account settings, but no refunds will be provided for partial subscription periods.

5.3 Non-Payment

Failure to pay subscription fees may result in suspension or termination of your access to the Software’s premium features.

6. User Responsibilities

6.1 Compliance With Laws

You agree to use the Software in compliance with all applicable laws, regulations, and third-party rights.

6.2 Accuracy of Information

You are responsible for the accuracy and legality of any data or content uploaded, entered, or generated through the Software.

6.3 Account Security

You are solely responsible for maintaining the confidentiality of your account credentials and for all activities conducted under your account. Notify appforest immediately of any unauthorized use.

7. Privacy and Data Usage

Your use of the Software is governed by appforest’s Privacy Policy, which explains how We collect, use, and protect your data. By using the Software, You consent to such data practices. 

8. Disclaimer of Warranties

The Software is provided “AS IS” and “AS AVAILABLE,” without warranties of any kind, whether express or implied, including but not limited to:

• Fitness for a particular purpose.
• Merchantability.
• Non-infringement.
  appforest does not guarantee that the Software will be error-free, uninterrupted, or meet your specific requirements.

9. Limitation of Liability

To the fullest extent permitted by law:

• appforest shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits or data.
• appforest’s total liability for direct damages shall not exceed the amount You paid for the Software in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless appforest, its affiliates, officers, and employees from any claims, damages, or losses arising from:

• Your breach of this Agreement.
• Your use or misuse of the Software.
• Any third-party claims related to content You upload or share through the Software.
